Welcome to KermitCloud Hosting. By purchasing or using any of our services, including Minecraft hosting, Discord bot hosting, VPS hosting, web hosting, or any other services we provide, you agree to these Terms of Service ("Terms").

1. Acceptance of Terms

By using KermitCloud Hosting's services, you confirm that you have read, understood, and agree to these Terms of Service. If you do not agree, you must not use our services.

2. Services

KermitCloud Hosting provides hosting services including, but not limited to:

  • Minecraft Server Hosting

  • Discord Bot Hosting

  • VPS Hosting

  • Web Hosting

  • Dedicated Server Solutions

  • Additional hosting-related services

Service availability is not guaranteed and may change without notice.

3. Account Responsibility

You are responsible for:

  • Keeping your account credentials secure.

  • All activity that occurs under your account.

  • Providing accurate billing information.

  • Maintaining backups of your own data.

KermitCloud Hosting is not responsible for unauthorized access resulting from compromised credentials.

4. Acceptable Use Policy

You agree not to use our services for:

  • Illegal activities.

  • Malware, ransomware, viruses, or phishing.

  • Distributed Denial of Service (DDoS) attacks.

  • Cryptocurrency mining unless explicitly permitted.

  • Hosting copyrighted material without authorization.

  • Spam or mass unsolicited messaging.

  • Exploiting vulnerabilities or attempting unauthorized access.

  • Any activity that negatively impacts other customers or our infrastructure.

Violation of this policy may result in immediate suspension or termination without refund.

5. Resource Usage

Customers may only use the CPU, RAM, storage, and bandwidth allocated to their plan.

Excessive resource usage that negatively impacts other users may result in temporary suspension until the issue is resolved.

6. Payments

  • Services are billed in advance.

  • Failure to pay by the due date may result in suspension.

  • Accounts may be terminated after an extended period of non-payment.

  • Prices are subject to change with reasonable notice.

  • Chargebacks or payment disputes may result in immediate account termination.

7. Refund Policy

Unless otherwise stated:

  • Refunds are available within 1 hours of the initial purchase if the service has not been abused.

  • Renewals are generally non-refundable.

  • Dedicated servers, VPSs, domains, software licenses, setup fees, and custom services are non-refundable.

  • Refund requests are reviewed individually.

8. Service Availability

While we strive for maximum uptime, we do not guarantee uninterrupted service.

Scheduled maintenance, hardware failures, software issues, attacks, or circumstances beyond our control may cause temporary downtime.

9. Data Backups

Customers are solely responsible for maintaining backups of their files and databases.

Although KermitCloud Hosting may perform backups, these are provided without guarantee and should not be relied upon as your only backup.

10. Suspension and Termination

We reserve the right to suspend or terminate services for reasons including:

  • Violation of these Terms.

  • Abuse of our network.

  • Fraudulent activity.

  • Failure to pay.

  • Threatening or abusive behavior toward staff.

Termination may occur without prior notice in severe cases.

11. Abuse Toward Staff

Harassment, threats, discrimination, or abusive language directed toward KermitCloud Hosting staff will not be tolerated and may result in immediate service termination.

12. Limitation of Liability

KermitCloud Hosting is not liable for:

  • Lost profits

  • Lost data

  • Business interruption

  • Indirect or consequential damages

  • Service interruptions beyond our reasonable control

Our maximum liability shall not exceed the amount paid for the affected service during the previous billing period.

13. Service Modifications

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice whenever possible.

14. Privacy

We collect only the information necessary to provide and manage our services.

We will not sell your personal information to third parties. Information may be disclosed when required by law or to protect our services from abuse.

15. Changes to These Terms

These Terms may be updated at any time.

Continued use of our services after changes become effective constitutes acceptance of the revised Terms.
