KermitCloud Hosting – Terms of Service

Welcome to KermitCloud Hosting. By using our services, including but not limited to Minecraft server hosting, Discord bot hosting, and related services (collectively, the “Services”), you agree to comply with and be bound by the following Terms of Service (“TOS”). If you do not agree to these terms, do not use our Services.

1. Eligibility

  • You must be at least 13 years old to use our Services.

  • By agreeing to this TOS, you confirm that you meet this requirement.

2. Account Responsibility

  • You are responsible for maintaining the confidentiality of your account login details.

  • You are responsible for all activities that occur under your account.

  • You must provide accurate and complete information when creating an account.

  • You agree not to share your account or grant access to third parties.

3. Use of Services

You agree to use our Services lawfully and responsibly, including:

  • Not hosting or distributing illegal content.

  • Not attempting to hack, exploit, or disrupt KermitCloud Hosting or other users.

  • Not using our Services for spamming, phishing, or any malicious activity.

We reserve the right to suspend or terminate accounts that violate these rules.

4. Payment and Refunds

  • All paid services are billed according to the selected plan.

  • Payments are non-refundable unless otherwise stated.

  • We reserve the right to change pricing or billing terms at any time.

For refunds due to technical issues, you must contact support within 14 days of the issue. Refunds are granted at our discretion.

5. Service Availability

  • KermitCloud Hosting strives for maximum uptime but does not guarantee 100% uptime.

  • Maintenance, technical failures, or unforeseen events may cause temporary service interruptions.

  • We are not liable for any losses or damages caused by service downtime.

6. Content and Data

  • You retain ownership of your content but grant KermitCloud Hosting the right to store, transmit, and display it to provide Services.

  • We are not responsible for the loss, deletion, or corruption of your data.

  • You are responsible for backing up your data.

7. Termination

We may suspend or terminate your account at our discretion if:

  • You violate these TOS.

  • You engage in illegal or abusive behavior.

  • Payment is not received or is reversed.

Upon termination, access to your services and data may be immediately revoked.

8. Limitation of Liability

KermitCloud Hosting, its owners, employees, and partners are not liable for:

  • Direct, indirect, incidental, or consequential damages.

  • Loss of data, revenue, or reputation.

  • Unauthorized access or breaches.

Our total liability will never exceed the amount you have paid for our Services.

9. Indemnification

You agree to indemnify and hold harmless KermitCloud Hosting from any claims, damages, or legal fees arising from your use of the Services or violation of these TOS.

10. Changes to TOS

We reserve the right to update or modify these TOS at any time.

  • Changes take effect immediately upon posting.

  • Continued use of the Services after updates constitutes acceptance of the new TOS.

11. Governing Law

These TOS are governed by the laws of the United States, without regard to conflicts of law principles.
